Just War Theory debates discussing the principle of the Moral Equality of Combatants involve the notion of Invincible Ignorance; the claim that warfi ghters are morally excused for participating in an unjust war because of their epistemic limitations. Conditions of military deployment may indeed lead to genuinely insurmountable epistemic limitations. In other cases, these may be overcome. This paper provides a preliminary sketch of heuristics designed to allow a combatant to judge whether or not his war is just. It delineates (...) the sets of relevant facts uncontroversially accessible and inaccessible to contemporary professional soldiers. Relevant facts outside these two sets should by default be treated as inaccessible until proven otherwise. Even such a rudimentary heuristic created in this way demonstrates that practical recommendations of MEC-renouncing Just War Theory are not too challenging to follow and still signifi cantly impact a compliant combatant’s behavior. There are several strong moral reasons for restoring the practice of parole for prisoners of war (POWs), that is, allowing them to spend their POW internment in a neutral country or in their own country provided they abstain from any military activity. This article makes an ethical case for parole, while discussing thoroughly theoretical as well as practical arguments against its reintroduction. The article suggests ways to create a reliable, internationally recognized way of paroling POWs. It concludes that the reintroduction (...) of parole as such is both ethically required and practically possible, and that it would reduce the needless suffering among POWs that exists under a system that does not allow for parole. Allowing prisoners of war (POW) to be released on parole ceased to be practiced in early XX century, although for centuries it was quite common in European warfare. In this article I argue there are several powerful moral reasons to reinstate POW parole: the well- being of POW and their families, but also a chance to address the previously intractable problem of surrender to aircraft and autonomous weapons. I also argue that there are no good moral reasons not to allow (...) POW to accept parole, and that the reasons commonly put forward against the practice of parole are usually informed by antiquated and flawed ethical attitudes. I subsequently offer solutions for overcoming the practical obstacles to reinstating the practice of parole utilizing commonly available technology and self-enforcing diplomatic arrangements. I provide a detailed outline of such arrangements, addressing a number of possible objections and testing the model against several hypothetical scenarios. (shrink)

Efforts to ban Autonomous Weapon Systems were both unsuccessful and controversial. Simultaneously the need to address the detrimental aspects of AWS development and proliferation continues to grow in scope and urgency. The article presents several regulatory solutions capable of addressing the issue while simultaneously respecting the requirements of military necessity and so attracting a broad consensus. Two much stricter solutions – regional AWS bans and adoption of a no first use policy – are also presented as fallback strategies in case (...) achieving AWS’ compliance with the Laws of Armed Conflict proved elusive. Together, the solutions presented form an outline of a flexible regulatory strategy able to adjust to different technological outcomes and providing a sensible compromise to solve the current deadlock on the AWS issue. Arguments from human dignity feature prominently in the Lethal Autonomous Weapons moral feasibility debate, even though their exists considerable controversy over their role and soundness and the notion of dignity remains under-defined. Drawing on the work of Dieter Birnbacher, I fix the sub-discourse as referring to the essential value of human persons in general, and to postulated moral rights of combatants not covered within the existing paradigm of the International Humanitarian Law in particular. I then review and critique dignity-based arguments (...) against LAWS: argument from faulty targeting process, argument from objectification, argument from underappreciation of the value of human life and the argument from the absence of mercy. I conclude that the argument from the absence of mercy is the only dignity-based argument that is both valid and irreducible to another class of arguments within the debate, and that it offers insufficient justification for a global ban on LAWS. The subject of this paper is the notion of similarity between the actual and impossible worlds. Many believe that this notion is governed by two rules. Ac-cording to the first rule, every non-trivial world is more similar to the actual world than the trivial world is. The second rule states that every possible world is more similar to the actual world than any impossible world is. The aim of this paper is to challenge both of these rules. We argue that (...) acceptance of the first rule leads to the claim that the rule ex contradictione sequitur quodlibet is invalid in classical logic. In his recent JME article Daniel Restrepo argues that both legal and ethical rules should protect the so-called Naked Soldiers, combatants engaged in activity unrelated to military operations and unaware of the imminent danger threatening them. I criticize this position from several angles. I deny the existence of any link between vulnerability and innocence, and claim ignorance of deadly threats does not give rise to a morally distinguished type of vulnerability. I argue that actions not contributing to the war effort (...) are nevertheless an inherent part of fighting a war, and that combatants do not signal intention to abandon their commitment to the war effort by undertaking these. I show that by granting hors de combat status to Naked Soldiers, we would unjustly disadvantage their opponents and engender significant and manifold practical difficulties that the proponents of the view fail to solve or even anticipate. Finally, I demonstrate that Restrepo’s general project of “making killing in war difficult to legitimately justify” regardless of why, how and by whom the killing is done is incompatible with just war theory’s basic assumptions. That project is in fact pacifist in nature and as such redundant in light of pacifism’s broader and stronger implications. (shrink)

The ethical Principle of Proportionality requires combatants not to cause collateral harm excessive in comparison to the anticipated military advantage of an attack. This principle is considered a major (and perhaps insurmountable) obstacle to ethical use of autonomous weapon systems (AWS). This article reviews three possible solutions to the problem of achieving Proportionality compliance in AWS. In doing so, I describe and discuss the three components Proportionality judgments, namely collateral damage estimation, assessment of anticipated military advantage, and judgment of “excessiveness”. Some possible approaches to Proportionality compliance are then presented, such as restricting AWS operations to environments lacking civilian presence, using AWS in targeted strikes in which proportionality judgments are pre-made by human commanders, and a ‘price tag’ approach of pre-assigning acceptable collateral damage values to military hardware in conventional attritional warfare. The article argues that application of these three compliance methods would result in AWS’ achieving acceptable Proportionality compliance levels in many combat environments and scenarios, allowing AWS to perform most key tasks in conventional warfare. In this paper, I analyze the semantics of the first person pronoun “I” from the perspective of the user/producer distinction. In the first part of the paper, I describe the Simple View and propose three interpretations of its thesis. In the second part, I analyze the notions of use and production of a linguistic token. In the next part, I show that all of the interpretations of SV are sensitive to counterexamples. In the end, I discuss possible answers of the (...) proponents of SV and argue against them. The first aim of this paper is to show that SV is wrong, and the second is to convince the reader that the user/producer distinction is of high importance in the philosophy of language. (shrink)

In this paper we present a solution to Saul Kripke’s Puzzle About Belief Meaning and use, Dordrecht, 1979) based on Kaplan’s metaphysical picture of words. Although it is widely accepted that providing such a solution was one of the main incentives for the development of Kaplan’s theory, it was never presented by Kaplan in a systematic manner and was regarded by many as unsatisfactory. We agree with these critiques, and develop an extension of Kaplan’s theory by introducing the notion of (...) “conservative” word uses, as well as arguing for the restriction of Kripke’s Disquotational Principle only to such uses. This restriction allows us to solve Kripke’s Puzzle by arguing that the assent of the puzzle’s protagonist does not allow disquotation and ascription of corresponding inconsistent belief, as it contains the non-conservative use of a proper name. At the end of the paper, we defend two of Kaplan’s theses that we find essential for our argument to work: that individuation of word tokens involves taking into account the intention of the speaker, and that different uniquely referring proper names of the same shape should be regarded as different homonymous words. The aim of this article is to introduce the work of Leopold Blaustein — philosopher and psychologist, who studied under Kazimierz Twardowski in Lvov and under Husserl in Freiburg im Breisgau. In his short academic career Blaustein developed an original philosophy that drew upon both phenomenology and Twardowski’s analytical approach. One of his main publications concerns Husserl’s early theory of intentional act and object, introduced in Logische Untersuchungen. In the first part of the article I briefly present Blaustein’s biography and (...) some general features of his philosophy. The second part provides an overview of Blaustein’s dissertation concerning Husserl’s early phenomenology. In the third and final part I summarize Blaustein’s research, including the critical remarks of Roman Ingarden. (shrink)

In this paper, I argue that the phenomenon of faultless disagreement for predicates of taste may be fruitfully explained by appealing to the vagueness of predicates of taste and the epistemicist reading of vagueness as defended by Timothy Williamson (1994). I begin by arguing that this position is better suited to explain both the “faultless” and “disagreement” intuition. The first is explained here by appealing to the necessary ignorance of the predicate’s boundaries and a plausible account of constitutive norms of (...) taste assertions, while the second by insisting on classical, absolutist semantics for judgments containing predicates of taste. Furthermore, I analyze the arguments against the reading of taste predicates as vague based on the alleged epistemic privilege concerning one’s taste and on the lack of definite cases. Responding to these objections, I develop a plausible account of constitutive norms of taste assertions, comment on the assumed epistemic privilege concerning taste ascriptions and provide a more detailed account of sources of the vagueness of predicates of personal taste, which I dub “super-vagueness.”. To solve the problem of counterpossibles, many philosophers have been arguing that one needs to invoke impossible worlds. This extension of the ontology of modality should save the analysis of counterfactuals from being insensitive to the problem of counterpossibles. Since theories of impossible worlds are extensions of original accounts of modalities, it is worth stressing that proper analyses of counterpossibles should not weaken the latter.In this paper I argue that these theories of impossible wolrds, which are based on D. Lewis' (...) modal realism - Extended Modal Realism and Hybrid Modal Realism - might be consider as either an unattractive for modal realists or insufficient for analyzing counterpossibles. (shrink)

In contemporary positive law there are legal institutions, such as conscientious objection in the context of military service or “conscience clauses” in medical law, which for the sake of respect for judgments of conscience aim at restricting legal obligations. Such restrictions are postulated to protect human freedom in general. On the basis of Thomas Aquinas’ philosophy, it shall be argued that human dignity, understood as the existential perfection of a human being based on special unity, provides a foundation for imposing (...) limitations on the scope of legal obligations in general. Human freedom plays a crucial role in understanding dignity as perfection based on the special individuality of a personal being, which in turn is based on the free choice to pursue a unique way of life. Therefore, Aquinas’ argumentation is, at its core, liberal – the perfection rather than the imperfection of a human being underlies the requirement to limit legal obligations. Dignity understood as the special unity of a person also provides the basis for limiting obligations in the case of conscientious objection; however, in that case, such limitations aim at safeguarding internal integrity rather than the individualisation of a given way of life. _This project was financed with funds from the National Science Centre allocated on the basis of the decision number DEC-2013/09/B/HS5/04232._. The common view has it that there are two families of approaches towards the logical structure of impossible worlds – Australasian and North American. According to the first, impossible worlds are closed under the relation of logical consequence of one of the non-classical logics. The North American approach is more liberal, allowing for impossible worlds where no logic holds. After pointing out the questionable consequences of each view, I propose a third one. While this new perspective allows for worlds where (...) no logical consequence holds, it also imposes some constraints on what worlds are built upon. This renders the proposed view not as restrictive as the Australasian approach and not as liberal as the North American approach. Due to its intermediary nature, I have named this perspective ‘the Pacific’ approach. (shrink)

In this article, I consider the cases of religious Moorean propositions of the form ‘d, but I don't believe that d’ and ‘d, but I believe that ~d’, where d is a religious dogma, proposition, or part of a creed. I argue that such propositions can be genuinely and rationally asserted and that this fact poses a problem for traditional analysis of religious assertion as an expression of faith and of religious faith as entailing belief. In the article, I explore (...) the possibility of undermining these commonly held assumptions and argue that the assertability of religious Moorean propositions can be justified by an account of faith as an intention to form religious beliefs. In the end, I also consider the consequences of such a stance, especially concerning the debate on the ethics of religious belief and doxastic voluntarism. (shrink)

Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

In this paper, I critically examine Kurt Gödel’s argument against the syntactic interpretation of mathematics. While the main aim is to analyze the argument, I also wish to underscore the relevance of the original elements of Gödel’s philosophical thought. The paper consists of four parts. In the first part, I introduce the reader to Gödel’s philosophy. In the second part, I reconstruct the formalist stance in the philosophy of mathematics, which is the object of Gödel’s criticism. The debate on the ethical permissibility of autonomous weapon systems (AWS) is deadlocked. It could therefore benefit from a differentiated assignment of the burden of proof. This is because the discussion is not purely philosophical in nature, but has a legal and security policy component and aims to avoid the most harmful outcomes of an otherwise unchecked development. Opponents of a universal AWS ban must clearly demonstrate that AWS comply with the Law of Armed Conflict (LOAC). This requires extensive testing (...) of specific models to verify compliance in realistic combat situations; working on appropriate testing regimes is also one of the most important future tasks for AWS ethics. In this context, however, it is easy to refute the claim put forward by prohibitionists that AWS violate LOAC a priori. A state’ s right to ensure security and the protection of human rights through military capacity has a high ethical value. Other arguments against the use of AWS that are not based on LOAC conformity must therefore meet a substantial burden of proof, as they call on governments to abandon a military technology which is at least potentially transformative. None of those objections meet this standard. They include not only culturally or even individually divergent norms and ideas regarding the use of weapons, but also consequentialist (security policy) concerns on the one hand and so-called deontological arguments on the other. While the former at least point to the need for essential regulation, the latter are based on rather dubious premises. For the purposes of solutions beneficial to humanity, prohibitionist should formulate narrower and more specific points of criticism. (shrink)

The insinuating speaker, when successful, achieves two goals: they introduce a contentious content into a conversation while simultaneously marking it as not being officially stated. This positioning allows the speaker to plausibly deny any intention behind the implied message when challenged. I argue that reconciling the communicative nature of insinuation and its off-record status within the Gricean framework of overt communication appears to present a significant conceptual puzzle. In this paper, I address this challenge by introducing the notion of Gricean (...) insinuation, which I define as communication that is both partially overt and partially covert. I start by exploring the nature and complexity of the insinuation puzzle mentioned earlier and reviewing two existing Gricean solutions to it. Then, I proceed to analyse three concepts relevant to the insinuation phenomenon: indirectness, cancellability, and plausible deniability. Following this, I introduce the concept of Gricean insinuation. In particular, I use the common ground framework to elucidate what I refer to as the ‘Fake One-Way Mirror Effect’, and apply the resulting model to explain some examples of insinuation as acts of off-record communication. In conclusion, I assess the model’s effectiveness and propose directions for future research. (shrink)

According to The Consensus Gentium Argument from the premise: “Everyone believes that God exists” one can conclude that God does exist. In my paper I analyze two ways of defending the claim that somebody’s belief in God is a prima facie reason to believe. Kelly takes the fact of the commonness of the belief in God as a datum to explain and argues that the best explanation has to indicate the truthfulness of the theistic belief. Trinkaus Zagzebski grounds her defence (...) on rationality of epistemic trust in others. In the paper I argue that the second line of reasoning is more promising and I propose its improved version. In a few short paragraphs of The Problems of Philosophy Bertrand Russell presents his theory of introspective knowledge based on the concept of knowledge by acquaintance. In this article, I critically analyze these comments by Russell and their proposed application by contemporary authors, including Brie Gertler (2001; 2011) and Laurence BonJour (2003). I show how these theories differ from the competing ‘inner‑sense theories’ and try to show that they are inconsistent with Gareth Evans’s ‘transparency’ observation. Then I compare acquaintance theories (...) with Alex Byrne’s (2005; 2012) ‘transparency’ theory and show that Byrne’s theory offers a simpler account of mechanisms governing introspection and attribution of mental states to other agents. "The main aim of the paper is to compare two types of abstractionistic accounts of fictional objects, and to analyze their consequences for interpretation of existential quantification. According to a proponent of general abstractionistic theory, fictional objects have abstract nature in a way similar to contracts, marriages, and the likes. This view is an alternative to strongly realistic accounts of fictional objects, defended by Terence Parsons or David Lewis. Within abstractionistic theories, as in all philosophical areas, one can find divergences (...) of opinions. The main differences between two of them – Peter van Inwagen's and Edward Zalta's – are connected with the interpretation of existential quantification. According to van Inwagen, “being” is the same as “existence” and its sense is captured by the existential quantifier. Edward Zalta's theory is much closer to the Meinongian Theory of Objects. He argues for the need of distinguishing between “being” and “existence” and for invoking nonexistent objects. Because of that he suggests an alternative interpretation of quantification. Admittedly, there is one abstractionistic source for both theories, but their ontological consequences are different - van Inwagen is a staunch opponent of nonexistent objects, and Zalta describes his own theory as "Meinongian".". The paper presents some historical (Plato, Aristotle, Plotin, Augustine, Boethius, Aquinas) and main contemporary topics about different accounts of goodness of God understood as ontological goodness, perfection and as ethical goodness - impeccability and benevolence. The arguments for goodness of God are presented, mainly from stance of Thomas Aquinas classical theism as well as arguments against compatibility of essential goodness and omnipotence (N. Pike) and being an moral agent. The article draws perspective of different philosophical issues connected with goodness of (...) God, like a problem of evil, the Euthyphro dilemma, divine command ethics and divine motivation theory. (shrink)

In this paper I consider the concept of an illocutionary rule - i.e., the rule of the form "X counts as 7 in context C" - and examine the role it plays in explaining the nature of verbal communication and the conventionality of natural languages. My aim is to find a middle ground between John R. Searle's view, according to which every conventional speech act has to be explained in terms of illocutionary rules that underlie its performance, and the view (...) held by Ruth G Millikan, who seems to suggest that the formula "X counts as Y in context C" has no application in our theorizing about human linguistic practice. I claim, namely, that the concept of an illocutionary rule is theoretically useful, though not explanatorily basic. I argue that using the formula "X counts as Y in context C" we can classify illocutionary acts by what Millikan calls their conventional outcomes, and thereby make them susceptible to naturalistic explanation. On Relation between the Individual Character of Propositional Knowledge and Its Value -/- The paper presents two aspects of human propositional knowledge, objective and subjective. The former is based on the truth condition, and the latter on the belief condition. Then several problems of the value of knowledge are briefly presented. The last part contains two arguments for the sine qua non belief condition of knowledge, one of which concerns the problem of epistemic luck assumed in virtue.

The subject of my article is the principle of characterization – the most controversial principle of Meinong’s Theory of Objects. The aim of this text is twofold. First of all, I would like to show that Russell’s well-known objection to Meinong’s Theory of Objects can be reformulated against a new modal interpretation of Meinongianism that is presented mostly by Graham Priest. Secondly, I would like to propose a strategy which gives uncontroversial restriction to the principle of characterization and which allows (...) to avoid Russell’s argument. The strategy is based on the distinction between object- and metalanguage, and it applies to modal Meinongianism as well as to other so-called Meinongian theories. (shrink)

In this paper I consider the idea of external language and examine the role it plays in our understanding of human linguistic practice. Following Michael Devitt, I assume that the subject matter of a linguistic theory is not a psychologically real computational module, but a semiotic system of physical entities equipped with linguistic properties. 2 What are the physical items that count as linguistic tokens and in virtue of what do they possess phonetic, syntactic and semantic properties? According to Devitt, (...) the entities in question are particular bursts of sound or bits of ink that count as standard linguistic entities3 — that is, strings of phonemes, sequences of words and sentences — in virtue of the conventional rules that constitute the structure of the linguistic reality. In my view, however, the bearers of linguistic properties should rather be understood as complex physical states of affairs — that I call, following Ruth G. Millikan, complete linguistic signs4 — within which one can single out their narrow and wide components, that is, (0 sounds or inscriptions produced by the speaker and (if) salient aspects of the context of their production. Moreover, I do not share Devitt's view on the nature of linguistic properties. Even though I maintain the general idea of convention-based semantics — according to which semantic properties of linguistic tokens are essentially conventional — I reject the Lewisian robust account of conventionality. Following Millikan, I assume that language conventions involve neither regular conformity nor mutual understanding. (shrink)

In 1947 Quine wrote one of the most important and influential articles in the twentieth century philosophy - "On What There Is". One of the aims of this article was a critique of Meinong's Theory of Object. The critique was especially focused upon nonactual possibilities, which (according to Meinong) are some kinds of nonexistent objects. In my paper I want to present Neo-Meinongian refutations of Quine's critique. In order to do this I discuss: (i) the main thesis of "On What (...) There Is" ,(ii) premises of Meinongian Theory, (iii) views of proponents and opponents of the idea of nonexistent objects, (iv) Quine's critique aimed at nonactual possibilities, (v) Terence Parsons' theory, based on the distinction between nuclear and extranucler properties, and (vi) noneism, defended by Richard Routley. I also try to give a reply to the most popular critiques aimed at both Neo-Meinongian theories. The main conclusion is that Quine's critique and his arguments against nonactual possibilities aren't dangerous for theories endorsing Meinong's Theory of Object. Contrary to what Gilbert Ryle once claimed (If Meinongianism isn't dead, nothing is), Meinongian theories are still alive and doing well. (shrink)

Descriptions of bodies within the literature of the enactive approach to cognitive science exhibit an interesting dialectical tension. On the one hand, a body is considered to be a unity which instantiates an identity, forming an intrinsic basis for value. On the other, a living body is in a reciprocally defining relationship with the environment, and is therefore immersed and entangled with, rather than distinct from, its environment. In this paper I examine this tension, and its implications for the enactive (...) approach, particularly the enactive conceptions of life and bodies. Following the lead of others, I argue that enactive cognitive science can benefit from a deeper reading and integration with extant work on the complexity and multiplicity of the living body within feminist philosophy and feminist science studies. This book argues for the importance and commonness of reasonings concerning impossibilities. Its aim is twofold – descriptive and constructive. Since hypothetical reasoning about impossibilities calls for explanation, the book provides a comprehensive guide through popular semantic theories of conditionals. Each is examined from the perspective of the question of impossibilities and the logic and metaphysics surrounding them. This provides the ground for a further aim. In the final chapter, I endeavor to combine the best features of the existing theories (...) and explore the possibility of a novel hybrid account. (shrink)

Eric Olson and David Shoemaker argue that our numerical identity over time is irrelevant to such practical issues as moral responsibility or self-concern. Being the same individual at different moments in time may, in our case, can be seen as the preservation of the relevant biological processes (e.g., according to Olson), while psychological continuity, independent of these processes, may be crucial for such issues. I will defend the view that, contrary to the above authors, any conception of our diachronic identity (...) has ethical implications, at least with regard to the aforementioned issues. My argument has two basic assumptions. (1) The dispute over identity of persons is a dispute over the conditions of our persistence in time as the same individuals, whether we consider being a person as our essential property or not (e.g., Olson maintains the latter). The question is under what conditions I am the same as a particular earlier or later individual. (2) The pronoun “I,” on the other hand, is an essential component of practical reasoning, so also of ethical one. Thus, the debate on the persistence of persons concerns the identity conditions of the individuals to whom/which we refer when planning our future actions, formulating our intentions. My rational self-concern or my moral responsibility for past actions regards the individual to whom the pronoun refers. An additional result of my argument is to undermine the influential strategy of defending positions on our diachronic identity against the charge of controversial ethical implications. It cannot be argued in the case of every such controversy that a given ethical issue only apparently involves our identity, while in fact what is relevant to it is a different relation binding persons at different moments in time. He distinguishes four main different meanings of Polish word ‘szczęście’ and present a new classification of them based on two principles: the opposition of subjective and objective and between ordinary and philosophical language. Accordingly we can speak about luck, positive psychological states like different kinds of good emotions or feelings and pleasure, Greek eudaimonia and specifically philosophical, a very correct concept of happiness as a rationally justified deep and comprehensive satisfaction of one’s life taken in its wholeness. In this paper I present critically his classification and argue that subjective meanings are always related to objective concepts. (shrink)

Perceptual modalities have been traditionally considered the product of dedicated biological systems producing information for higher cognitive processing. Psychological and neuropsychological evidence is offered which undermines this point of view and an alternative account of modality from the enactive approach to understanding cognition is suggested. Under this view, a perceptual modality is a stable form of perception which is structured not just by the biological sensitivities of the agent, but by their goals and the set of skills or expertise which (...) they are deploying at a given time. Such a view suggests that there is no such thing as an experience that is purely visual, auditory, or otherwise modal and that our attempts to understand consciousness and the mind must be conducted within a framework that provides an account of embodied, goal-directed adaptive coping with the world. "Philosophical Foundations of Understanding of the Common Good". The central question is whether recognizing the common good as the central value in the new Polish Constitution of 1997, means accepting the primacy of the state over an individual. The answer is negative. The preparatory work to the constitution is analyzed and the philosophical perspective is outlined which corresponds to the intentions of the authors of the constitution. The analyses concentrate on the philosophical tradition reaching from Plato to Aristotle and Thomas (...) Aquinas. /////////////////// W nowej Konstytucji Rzeczypospolitej Polskiej przyjętej w 1997 roku, dobro wspólne jest jedną z fundamentalnych wartości. Centralne pytanie brzmi, czy uznanie dobra wspólnego za wartość fundamentalną, nie jest uznaniem prymatu państwa wobec jednostki, czy nie wprowadza do porządku konstytucyjnego idei totalitarystycznych. Odpowiedź na to pytanie jest negatywna. Argumentując, autor dokonuje analizy prac przygotowawczych do Konstytucji, oraz zmierza do zarysowania filozoficznej perspektywy rozumienia dobra wspólnego, perspektywy odpowiadającej intencjom twórców Konstytucji. W analizach położony jest akcent na filozoficzną tradycję refleksji nad dobrem wspólnym sięgającą od Platona poprzez Arystotelesa do Tomasza z Akwinu. -/- . (shrink)

In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban development (...) in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

The paper is a contribution to the debate on the epistemological status of thought experiments. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...) theory, focusing on the critique of eliminativism by Tamar Szabó Gendler based on the reconstruction of famous Galileo's Pisa experiment. I show that her reconstruction is simplistic and that more elaborate reconstruction is needed for an appropriate assessment of the epistemic power of general argument. I propose such a reconstruction and demonstrate that general version of Pisa experiment is epistemically equal to the particular one. Thus, from an epistemological perspective, Galileo's thought experiment is reducible to a straightforward argument without particular premises. (shrink)

An axiological analysis of the basis of the 1997 Constitution of the Republic of Poland, determined mainly in the Preamble, makes it possible to put forward a thesis that this axiology is not, at least in reference to the principle, eclectic. In respect of the meta-axiological settlements, this is a tradition of natural-law type, recognizing the objective grounding of values and law. The accepted solutions are also convergent with the axiology typical of the international protection of human rights. -/- Résumé (...) L’analyse des fondements axiologiques de la Constitution polonaise de 1997, inscrits avant tout dans le préambule, permet de formuler la thèse selon laquelle cette axiologie n’est pas, en principe, éclectique. La réflexion sur les valeurs s’inscrit dans la vision classique des fondements du droit, remontant à l’antiquité. Partant de là, se dégage une tradition juridique appuyée sur le droit naturel, reconnaissant la force objective des valeurs et du droit. Ces conclusions rejoignent l’axiologie classique de la protection internationale des droits de l’Homme. -/- Zusammenfassung Die Analyse der vor allem durch die Präambel definierten axiologischen Grundlagen der Verfassung der Republik Polen von 1997 ermöglicht die Aufstellung der These, dass diese Axiologie nicht eklektisch ist, zumindest nicht prinzipiell. Hier enthüllt sich ein Denken von den Werten, das sich in die klassische, bis in die Antike zurückreichende Reflexion über die Grundlagen des Rechts einfügt. Wegen der metaaxiologischen Entscheidungen ist das eine Tradition naturrechtlichen Typs, die die objektive Begründung der Werte und des Rechts anerkennt. Die angenommenen Lösungen stimmen auch mit der für den internationalen Schutz der Menschenrechte typischen Axiologie überein. (shrink)

The 2016-17 Iraqi offensive that recaptured the city of Mosul from the Islamic State have demonstrated the inability of contemporary armed forces to retake urban areas from a determined and ruthless enemy without either suffering debilitating casualties or causing thousands of civilian deaths and virtually destroying the city itself. The enemy’s willingness to refuse civilian evacuation via a humanitarian corridor and effectively take the inhabitants hostage is all it takes to impose this tragic dilemma on an attacking force. The civilian (...) death toll of the battle of Mosul alone is estimated to have reached between seven and forty thousand, with almost one million people internally displaced and large portions of the city levelled. Avoiding another such tragedy should be a priority for all practitioners and theorists of urban warfare. Indeed, confronting and defeating this challenge may be the most important task for ethics, theory and practice of urban combat in the coming decade. I argue that the only viable way of escaping the hostage siege dilemma consists of incorporating large numbers of unmanned and autonomous weapon systems into the blue force structure and using these to substitute for artillery and aerial fires presently being used to overpower defenders. While other measures may be used to marginally improve the outcome of hostage city assaults, only the automatization of the assault can dramatically change the calculus and in result either discourage rogue actors from creating hostage city dilemmas or defeat them decisively while suffering unequivocally proportional casualties. I proceed as follows: first, I provide an account of the 2016-17 Coalition assault on Mosul, giving special attention to the events and features relevant to the hostage city dilemma. I then use this case study to introduce the theoretical concept of the hostile city and the ethical dilemma it creates, discussing possible objections and making the case that the circumstances of the Battle of Mosul are bound to repeatedly transpire in the future. This generates a duty to find a way out of the hostage city dilemma. I argue that widespread use of unmanned and autonomous weapon platforms constitutes a viable way of assaulting hostage cities in a manner that assures respect for the ius in bello principles, proposing several ways in which such weapons may be designed and used to drastically limit both military and civilian casualties. Concluding that it may be not only permissible but morally required to employ autonomous weapons in the hostage city scenario, I briefly discuss the implications of this conclusion for a wider debate concerning the moral feasibility of autonomous weapons. The article provides an analysis of the European Court of Human Rights judgments in the case of Lautsi v. Italy (application no. 30814/06), also known as the Italian crucifix case. The applicant claimed that displaying crucifixes in the Italian State-school classrooms attended by her children was contrary to the principle of secularism, by which she wished to bring up her children, and therefore infringed her right to ensure their education and teaching in conformity with her religious and philosophical convictions, and (...) also breached her freedom of conviction and religion, as protected by Article 9 of the Convention. In its judgment of November 3, 2009, the seven-judge Chamber declared that there had been a violation of Article 2 (right to education) of Protocol No. 1 of the European Convention on Human Rights taken together with Article 9 (freedom of thought, conscience, and religion) of the Convention. The judgment was given unanimously and none of the judges appended a separate opinion. The Italian Government asked for the case to be referred to the Grand Chamber by virtue of Article 43 of the Convention. In the judgment of the Grand Chamber, delivered on March 18, 2011, the Court held, by fifteen votes to two (and with separate opinions of six judges), that there had been no violation of Protocol No. 1 and no violation of the Convention itself. The analysis in the article is focused on selected principal factors determining the Court's decision. It shows that the proposal for the Court to recognize secular convictions as those protected by Article 2 of Protocol No. 1 or Article 9 of the Convention has no sufficient basis in the Convention itself and in earlier Court's case-law and, even, may be considered as promotion of religious intolerance, threatening the freedom to publicly manifest a religion or belief, as guaranteed by Article 9 of the Convention. -/- Opracowanie zawiera analizę wyroków Europejskiego Trybunału, które zapadły w sprawie Soile Lautsi (app. 30814/06), zwaną „włoska sprawa krzyża” (Italian Crucifix Case). W sprawie tej skarżąca zarzucała, że okazywanie znaku krzyża w klasach włoskich szkół państwowych, do których uczęszczały jej dzieci, jest sprzeczne z zasadą sekularyzmu, zgodnie z którą chciała ona wychować swoje dzieci i dlatego stanowi naruszenie jej prawa do wychowania i nauczania zgodnego z jej religijnymi i filozoficznymi (moralnymi) przekonaniami, oraz stanowi naruszenie wolności religijnej, gwarantowanej art. 9 Konwencji. W wyroku siedmioosobowej izby ogłoszonym 3 listopada 2009 r. izba uznała naruszenie art. 2 (Prawo do nauki) Protokołu dodatkowego nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności w powiązaniu z art. 9 (Wolność myśli, sumienia i wyznania) Konwencji. Wyrok zapadł jednomyślnie i żaden z sędziów nie dołączył do wyroku swoich uwag. Rząd Włoch złożył wniosek w trybie przewidzianym art. 43 Konwencji o przekazanie sprawy do Wielkiej Izby. W wyroku Wielkiej Izby ogłoszonym 18 marca 2011 r. Trybunał uznał zdecydowaną większością głosów – 15 za wobec 2 przeciw (sześciu sędziów dołączyło swoje uwagi), że nie doszło do naruszenia ani Protokołu nr 1, ani samej Konwencji. Analizy koncentrują się na wybranych zagadnieniach, kluczowych dla argumentacji Trybunału. Analizy te pokazują, że postulowanie przez izbę uznania za prawo podmiotowe radykalnie pojętej negatywnej wolności religijnej, oraz postulowanie - tak przez izbę, jak i przez Wielką Izbę - ochrony przekonań sekularystycznych jako przekonań chronionych art. 2 Protokołu dodatkowego nr 1 lub art. 9 Konwencji, nie posiada należytego uzasadnienia ani w samej Konwencji, ani w dotychczasowym orzecznictwie Trybunału, a co więcej – może być uznane za propagowanie nietolerancji religijnej, godzącej przede wszystkim chronioną art. 9 Konwencji wolność publicznego uzewnętrzniania przekonań religijnych i filozoficznych. Is Divine Knowledge Incompatible with Human Freedom? An Analysis of Some Arguments The problem that divine omniscience or divine foreknowledge makes free will impossible belongs to notoriously difficult to solve. In XX century one of the most important interpretation of this difficulty was provided by Nelson Pike. If God believes infallibly and in advance how Smith will act, this fact about the past excludes out all alternatives for Smith. But libertarian account of free will requires alternatives possibilities, so, it could (...) be argue that God’s foreknowledge is incompatible with our free will. This paper carefully criticizes Pike’s argumentation and suggests that because God’s foreknowledge doesn’t eliminate future alternatives through causal means, it is compatible with free will and that Pike’s argument and two briefly analyzed standard arguments for fatalism presented by Zagzebski failed. Short paper about debate on cognitive meaning of religious use of language in early analytic philosophy of religion. Published in Companion to Philosophy of Religion, edited by Janusz Salamon, Cracow: WAM, 2016.

The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...) still, after more than two decades of transition and heavy international policy advising, be viewed as a “laboratory of social experimentation”. It is still too risky to suggest generalizations about how Central European higher education and welfare systems fit existing typologies. Consequently, the “transition” period is by no means over: it is over in terms of politics and economics but not in terms of social arrangements. Both higher education and welfare states should be viewed as “work in progress”: permanently under reform pressures, and with unclear future. (shrink)
